Gbbs Settles Local Attorneys Unlawful Arrest Case For 325000
Attorneys Robert Bennett, Andrew Noel, and Jeffrey Storms recently obtained a total settlement in the amount of $325,000 on behalf of a local attorney, who was unlawfully arrested by a Bloomington police officer. The arrest was preceded by a baseless allegation made by a manager at Pawn America that the attorney/plaintiff had sold and was selling counterfeit watches to the pawnshop.
After defeating Pawn America’s and the manager’s motions for summary judgment, the plaintiff entered into a confidential settlement agreement with those parties. The officer also sought summary judgment on grounds of qualified immunity, but her motion was likewise denied by the district court. The officer then filed an interlocutory appeal with the Eighth Circuit Court of Appeals, and the appellate court affirmed the lower court’s ruling.
This case was previously selected by Minnesota Law & Politics as a 2009 “Lawsuit of the Year.”
